Being injured in a workplace accident can be frustrating. Not only do you have to contend with your injuries, but you have to deal with your employer breathing down your neck and trying to make the whole thing go away. Oftentimes, employers will try to make you settle your claim as quickly as possible to save more of their money and prevent paying for additional injuries. While you might be stuck in an awkward position, there are a few things you need to know about your claim to prevent your employer from taking advantage of you.
You have the right to choose your own doctor.
Oftentimes, people who are injured at work are led to believe that they have to go to the employer's doctor to get treatment and a diagnosis. That is not the case at all. You have every right to go to your doctor and get an opinion and treatment plan for your condition. While you can choose to go to the employer's doctor, it isn't a requirement, nor can they prevent you from getting an opinion from your provider.
They cannot force you to settle.
When it comes to any type of injury where an employer is going to pay you while you aren't able to work, they will often try to get you to settle to put an end to the whole case as quickly as they can. The quicker they get you to settle, the less money they are going to be paying out-of-pocket. Don't ever feel intimidated or as if you have no choice but to settle. You deserve a fair amount of compensation and you can keep fighting until you are able to reach a fair agreement.
They cannot threaten to fire you while you are recovering from your injuries.
Unfortunately, many employers will threaten to fire you if you aren't able to return to work within a specific amount of time. You are allowed ample time to recover. They cannot terminate your position or let you go for something that you had no control over in the first place. Depending on how severe your injuries were, the length of time allowed to recover is going to vary.
